GENERAL POLICIES

EFFECTIVE DATE: JAN 7, 2025

GATZA ARCHITECTURE IS A PREMIER CUSTOM TRADE MANUFACTURER OF MODERN STAIRS, RAILINGS, ARCHITECTURAL GLASS, PIVOT DOORS, FEATURE WALLS, AND ALUMINUM PERGOLAS. ALL PRODUCTS ARE MADE TO ORDER WITH A STANDARD PRODUCTION LEAD TIME OF 20–90 BUSINESS DAYS, COMMENCING UPON CAD APPROVAL AND RECEIPT OF 60% PAYMENT. BY PLACING AN ORDER, CUSTOMERS AGREE TO THESE TERMS, WHICH GOVERN ALL TRANSACTIONS AND ENSURE A SEAMLESS PARTNERSHIP.

  • COMMITMENT TO EXCELLENCE

1.1 QUALITY FIRST: WE DELIVER HIGH-QUALITY CUSTOM PRODUCTS. PRODUCTION OR SUPPLY CHAIN CHALLENGES MAY CAUSE DELAYS, BUT QUALITY IS NEVER COMPROMISED.

1.2 DELAY NOTIFICATION: WE WILL NOTIFY CUSTOMERS OF DELAYS WITHIN 5 BUSINESS DAYS AND PROVIDE BIWEEKLY STATUS UPDATES UNTIL DELIVERY.

1.3 DELAY LIABILITY: GATZA ARCHITECTURE IS NOT LIABLE FOR COSTS (E.G., INSTALLATION, LABOR, EQUIPMENT RENTALS, MORTGAGE RATES, CERTIFICATES OF OCCUPANCY) ARISING FROM DELAYS, CONTRACTOR SCHEDULING CONFLICTS, OR FORCE MAJEURE EVENTS (E.G., NATURAL DISASTERS, SUPPLY CHAIN DISRUPTIONS).

1.4 SCHEDULING GUIDANCE: TO MINIMIZE COSTS, SCHEDULE INSTALLERS OR OUR PROFESSIONAL INSTALLATION SERVICE (AVAILABLE IN SELECT AREAS) ONLY AFTER DELIVERY AND INSPECTION.

1.5 GOODWILL COMMITMENT: IF DELAYS EXCEED 30 DAYS BEYOND THE ESTIMATED LEAD TIME DUE TO OUR ERROR, WE MAY OFFER A DISCOUNT UP TO 10% OF THE ORDER VALUE, AT OUR SOLE DISCRETION.

  • PAYMENT TERMS

2.1 ORDERS UNDER $2,500: FULL PAYMENT REQUIRED AT ORDER PLACEMENT, NON-REFUNDABLE EXCEPT AS SPECIFIED.

2.2 ORDERS OVER $2,500:
20% NON-REFUNDABLE DEPOSIT: INITIATES ENGINEERING AND CAD DRAWINGS; REFUNDED ONLY IF ENGINEERING IS IMPOSSIBLE (AT GATZA’S SOLE DISCRETION).
40% PRODUCTION PAYMENT: DUE UPON CAD APPROVAL TO COMMENCE MANUFACTURING, NON-REFUNDABLE.
FINAL BALANCE: DUE IN FULL PRIOR TO SHIPMENT, NON-REFUNDABLE.
2.3 PROFESSIONAL INSTALLATION: BILLED SEPARATELY VIA A SEPARATE INVOICE, PAYABLE PER PROVIDED TERMS.
2.4 PRODUCTION START: BEGINS ONLY AFTER CAD APPROVAL AND RECEIPT OF 60% OF THE ORDER TOTAL (DEPOSIT + PRODUCTION PAYMENT).
2.5 PAYMENT METHODS: CREDIT CARD PAYMENTS INCUR A 3% CONVENIENCE FEE (WAIVED FOR ORDERS OVER $100,000). ACH OR WIRE TRANSFERS PREFERRED; CONTACT US FOR DETAILS.
2.6 LATE PAYMENTS: OVERDUE BALANCES INCUR A 1.5% MONTHLY FINANCE CHARGE AND MAY SUSPEND PRODUCTION OR DELAY SHIPMENT UNTIL RESOLVED.
2.7 NON-REFUNDED PAYMENTS: ALL PAYMENTS ARE NON-REFUNDABLE EXCEPT IN CASES OF CANCELLATION PER SECTION 4 OR ENGINEERING IMPOSSIBILITY.

  • PRICING AND PROMOTIONS

3.1 PRICE ADJUSTMENTS: PRICES ARE SUBJECT TO CHANGE WITHOUT NOTICE. PRICING ERRORS MAY BE CORRECTED POST-ORDER, WITH CUSTOMER NOTIFICATION WITHIN 2 BUSINESS DAYS AND THE OPTION TO CANCEL WITH A FULL REFUND (LESS ENGINEERING FEES).
3.2 ESTIMATES: VALID FOR 30 DAYS; FINAL PRICING CONFIRMED VIA OUR ESTIMATE APP UPON CUSTOMER APPROVAL. DISCOUNTS TIED TO ACTIVE PROMOTIONS.
3.3 PRICE LOCK-IN:
PRICING LOCKED FOR 12 MONTHS UPON DEPOSIT RECEIPT; INCREASES 0.5% MONTHLY THEREAFTER.
ORDERS OPEN AFTER 24 MONTHS ARE SUBJECT TO REPRICING AT CURRENT RATES.
3.4 COST ESCALATION: IF MATERIAL OR PRODUCTION COSTS INCREASE BY 20% OR MORE, GATZA MAY PROPOSE REPRICING WITH CUSTOMER APPROVAL OR CANCEL THE ORDER, REFUNDING PAYMENTS LESS ENGINEERING FEES.
3.5 PROMOTIONAL TERMS: PROMOTIONS CANNOT BE COMBINED UNLESS EXPLICITLY STATED AND ARE SUBJECT TO AVAILABILITY AND EXPIRATION.

  • PRODUCTION AND LEAD TIMES

4.1 ORDER FINALIZATION: NO CHANGES OR MODIFICATIONS PERMITTED AFTER PRODUCTION BEGINS, TYPICALLY UPON RECEIPT OF PRODUCTION PAYMENT.
4.2 LEAD TIME ESTIMATES: PROVIDED IN BUSINESS DAYS, EXCLUDING SHIPPING. DELAYS MAY OCCUR DUE TO COMPLEXITY, SUPPLY CHAIN ISSUES, OR FORCE MAJEURE. GATZA IS NOT LIABLE FOR COSTS OR CONTRACTOR CONFLICTS ARISING FROM DELAYS.
4.3 STORAGE FEES: ORDERS HELD BEYOND 5 BUSINESS DAYS AFTER COMPLETION AT CUSTOMER’S REQUEST INCUR A STORAGE FEE OF UP TO $100 PER DAY.
4.4 CANCELLATION POLICY:
BEFORE CAD APPROVAL: ENGINEERING FEES OF $800–$4,000 BASED ON DESIGN COMPLEXITY; NO FEE FOR NON-ENGINEERED ORDERS.
POST-CAD APPROVAL: 10% OF PRODUCT TOTAL.
POST-MATERIAL ORDERING: 25% OF PRODUCT TOTAL.
AFTER 180 DAYS: 40% OF PRODUCT TOTAL.
AFTER PRODUCTION STARTS: NO CANCELLATIONS PERMITTED (TYPICALLY SAME DAY FOR NON-ENGINEERED ITEMS).
4.5 FORCE MAJEURE: GATZA IS NOT LIABLE FOR DELAYS, CANCELLATIONS, OR PERFORMANCE FAILURES DUE TO UNFORESEEN CIRCUMSTANCES BEYOND OUR CONTROL, INCLUDING BUT NOT LIMITED TO NATURAL DISASTERS, LABOR DISPUTES, OR SUPPLY CHAIN DISRUPTIONS.
4.6 EXCEPTIONAL CANCELLATIONS: IN RARE CASES (E.G., DOCUMENTED FINANCIAL HARDSHIP), CANCELLATIONS MAY BE APPROVED WITH MUTUAL AGREEMENT, SUBJECT TO APPLICABLE FEES.

  • COASTAL ENVIRONMENTS

5.1 RECOMMENDED MATERIALS: FOR INSTALLATIONS WITHIN 10 MILES OF SALTWATER, USE POWDER-COATED ALUMINUM POSTS, EXTREME COASTAL 2205 STAINLESS STEEL POSTS/RODS, GLASS RAILINGS, OR REINFORCED ALUMINUM HANDRAILS TO ENSURE DURABILITY AND WARRANTY COVERAGE.
5.2 WARRANTY EXCLUSION: STAINLESS STEEL POSTS USED OUTDOORS IN COASTAL AREAS (E.G., LONG ISLAND, COASTAL CT) VOID THE WARRANTY DUE TO CORROSION RISK. CUSTOMERS ASSUME ALL RISKS FOR NON-RECOMMENDED MATERIALS.

  • CODE COMPLIANCE

6.1 CUSTOMER RESPONSIBILITY: CUSTOMERS ARE SOLELY RESPONSIBLE FOR ENSURING PRODUCTS COMPLY WITH LOCAL BUILDING CODES AND REGULATIONS. GATZA IS NOT LIABLE FOR NON-COMPLIANCE OR ASSOCIATED COSTS.
6.2 OPTIONAL CODE SUPPORT: CODE CONSULTATION AND COMPLIANCE DOCUMENTATION SERVICES AVAILABLE STARTING AT $500 PER PROJECT. CAD DRAWINGS ARE FOR MANUFACTURING PURPOSES ONLY AND NOT A SUBSTITUTE FOR PROFESSIONAL CODE VERIFICATION.
6.3 RECOMMENDATION: CONSULT LOCAL AUTHORITIES OR LICENSED PROFESSIONALS PRIOR TO ORDERING TO CONFIRM COMPLIANCE.

  • DAMAGES AND SHORTAGES

7.1 REPORTING DEADLINE: DEFECTS, DAMAGES, OR SHORTAGES MUST BE REPORTED WITHIN 5 BUSINESS DAYS OF DELIVERY TO CONTACT@GATZACORP.COM INCLUDING DETAILED DESCRIPTIONS AND PHOTO/VIDEO EVIDENCE.
7.2 POST-INSTALLATION CLAIMS: NO CLAIMS FOR DAMAGE OR DEFECTS HONORED AFTER INSTALLATION, AS DAMAGE MAY OCCUR DURING INSTALLATION.
7.3 LTL SHIPMENTS: ACCEPT DELIVERIES EVEN IF PACKAGING APPEARS DAMAGED, NOTING ISSUES ON THE BILL OF LADING (BOL) BEFORE SIGNING. GATZA WILL REPLACE VERIFIED DAMAGED ITEMS AT OUR DISCRETION (PHOTO/VIDEO REQUIRED; RETURNS MAY BE REQUESTED).
7.4 RESOLUTION PROCESS: VALID CLAIMS RECEIVE A RESPONSE WITHIN 7 BUSINESS DAYS AND A SOLUTION (REPAIR, REPLACEMENT, OR PARTIAL REFUND FOR MINOR ISSUES) WITHIN 14 BUSINESS DAYS, AT GATZA’S SOLE DISCRETION.
7.5 ITEM RETENTION: DAMAGED ITEMS MUST BE RETAINED UNTIL GATZA APPROVES DISPOSAL OR RETURN TO AVOID CLAIM DENIAL.
7.6 INSPECTION ADVISORY: CUSTOMERS ARE ENCOURAGED TO INSPECT DELIVERIES IMMEDIATELY UPON RECEIPT TO EXPEDITE CLAIMS.

  • RETURNS

8.1 RETURN WINDOW: RETURNS ACCEPTED WITHIN 90 DAYS OF SHIPMENT FOR RESALABLE, UNDAMAGED PRODUCTS.
8.2 RESTOCKING FEE: 20% OF PRODUCT VALUE (15% FOR ORDERS OVER $10,000).
8.3 NON-RETURNABLE ITEMS: WOOD, GLASS, AND MOST METAL PRODUCTS ARE NON-RETURNABLE. ELIGIBLE ITEMS INCLUDE CABLE RAILING POSTS, REINFORCED ALUMINUM/STAINLESS STEEL HANDRAIL FITTINGS, TENSIONERS, AND UNOPENED STAINLESS STEEL CABLE SPOOLS.
8.4 RETURN PROCESS: SUBMIT A RETURN GOODS AUTHORIZATION (RGA) FORM TO INITIATE. CUSTOMERS BEAR RETURN SHIPPING COSTS UNLESS THE RETURN IS DUE TO GATZA’S ERROR (E.G., DEFECTIVE PRODUCT). ITEMS INSPECTED WITHIN 10 BUSINESS DAYS; REFUNDS ISSUED WITHIN 14 BUSINESS DAYS OF APPROVAL.
8.5 CONDITION REQUIREMENTS: RETURNED PRODUCTS MUST BE IN ORIGINAL PACKAGING, UNUSED, AND RESALABLE TO QUALIFY.

  • SHIPPING

9.1 CARRIER SELECTION: GATZA SELECTS STANDARD FREIGHT CARRIERS; LOCAL DELIVERY AVAILABLE IN SELECT AREAS; SMALL PACKAGES SHIP VIA UPS OR US MAIL. CUSTOMER-PREFERRED CARRIERS PERMITTED AT CUSTOMER EXPENSE WITH PRIOR APPROVAL.
9.2 EXPRESS SHIPPING: AVAILABLE FOR PRODUCTION OR REPLACEMENT ITEMS AT CUSTOMER EXPENSE.
9.3 TRACKING INFORMATION: PROVIDED WITHIN 24 HOURS OF SHIPMENT VIA EMAIL.
9.4 LTL SHIPMENTS: HANDRAILS OR RODS OVER 8 FEET SHIP VIA LESS-THAN-TRUCKLOAD (LTL). CUSTOMERS MUST NOTE DAMAGES OR SHORTAGES ON THE BOL BEFORE SIGNING, OR REPLACEMENT COSTS APPLY.
9.5 ADDRESS CHANGES: POST-SHIPMENT ADDRESS CHANGES INCUR RE-CONSIGNMENT FEES OF $75–$250, PAYABLE BY THE CUSTOMER.
9.6 UNLOADING REQUIREMENTS: CUSTOMERS MUST PROVIDE 4–5 PERSONNEL OR A FORKLIFT FOR LARGE CRATES (E.G., GLASS PANELS). GATZA IS NOT LIABLE FOR UNLOADING DELAYS OR COSTS.
9.7 CUSTOMER PICKUP OPTION: ORDERS MAY BE PICKED UP AT OUR FACILITY WITH PRIOR ARRANGEMENT, WAIVING SHIPPING FEES.
9.8 DELIVERY CONFIRMATION: CARRIER TRACKING SERVES AS PROOF OF DELIVERY.

  • LIMITED WARRANTY

10.1 COVERAGE PERIOD: PRODUCTS ARE WARRANTED AGAINST MANUFACTURING DEFECTS FOR 2 YEARS FROM DELIVERY UNDER NORMAL USE CONDITIONS.
10.2 EXCLUSIONS: WARRANTY DOES NOT COVER DAMAGE DUE TO IMPROPER INSTALLATION, MISUSE, NEGLECT, UNAUTHORIZED MODIFICATIONS, OR ENVIRONMENTAL FACTORS (E.G., COASTAL CORROSION OF NON-RECOMMENDED MATERIALS).
10.3 CLAIMS PROCESS: SUBMIT WARRANTY CLAIMS TO CONTACT@GATZACORP.COM WITH PROOF OF PURCHASE AND PHOTO/VIDEO EVIDENCE. GATZA WILL RESPOND WITHIN 7 BUSINESS DAYS AND PROVIDE REMEDIES (REPAIR, REPLACEMENT, OR REFUND) AT OUR SOLE DISCRETION.
10.4 NON-TRANSFERABLE: WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER AND IS NON-TRANSFERABLE.
10.5 MATERIAL RECOMMENDATIONS: TO MAINTAIN WARRANTY COVERAGE, USE RECOMMENDED MATERIALS (E.G., POWDER-COATED ALUMINUM, 2205 STAINLESS STEEL) IN COASTAL ENVIRONMENTS.
10.6 LIMITATION: WARRANTY IS LIMITED TO THE PRODUCT VALUE; NO COVERAGE FOR CONSEQUENTIAL DAMAGES OR INSTALLATION COSTS.

  • DISPUTES AND LIABILITY

11.1 RESOLUTION COMMITMENT: GATZA STRIVES TO RESOLVE ISSUES PROMPTLY TO ENSURE CUSTOMER SATISFACTION. DISPUTES UNRESOLVED WITHIN 30 DAYS WILL BE SUBMITTED TO BINDING ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION IN DELAWARE.
11.2 CUSTOMER OBLIGATIONS: CUSTOMERS MUST PROVIDE ACCURATE MEASUREMENTS, SITE DETAILS, AND CAD APPROVALS. GATZA IS NOT LIABLE FOR ERRORS, ADDITIONAL PARTS, OR COSTS ARISING FROM INACCURATE OR INCOMPLETE CUSTOMER-PROVIDED INFORMATION.
11.3 LIABILITY LIMITATION: GATZA’S LIABILITY IS CAPPED AT THE ORDER VALUE. GATZA IS NOT LIABLE FOR CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES (E.G., LABOR COSTS, PROJECT DELAYS, LOST PROFITS).
11.4 INDEMNIFICATION: CUSTOMERS AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS GATZA ARCHITECTURE AGAINST CLAIMS, LOSSES, OR LIABILITIES ARISING FROM PRODUCT MISUSE, IMPROPER INSTALLATION, OR FAILURE TO COMPLY WITH LOCAL BUILDING CODES.
11.5 DRAWINGS AND QUOTES: CAD DRAWINGS, QUOTES, AND WEBSITE INFORMATION ARE FOR MANUFACTURING AND ESTIMATION PURPOSES ONLY AND DO NOT CONSTITUTE ENGINEERING OR CODE COMPLIANCE SERVICES. CUSTOMERS MUST ENGAGE LICENSED PROFESSIONALS FOR SAFETY AND COMPLIANCE.
11.6 LEGAL FEES: THE PREVAILING PARTY IN ANY DISPUTE IS ENTITLED TO RECOVER REASONABLE ATTORNEY FEES AND COSTS.

  • POLICY AMENDMENTS

12.1 MODIFICATIONS: GATZA RESERVES THE RIGHT TO AMEND THESE POLICIES AT ANY TIME. UPDATED POLICIES WILL BE POSTED AT WWW.GATZACORP.COM AND APPLY TO ORDERS PLACED AFTER THE EFFECTIVE DATE. CUSTOMERS WITH ACTIVE ORDERS WILL BE NOTIFIED OF MATERIAL CHANGES VIA EMAIL.
12.2 GOVERNING LAW: THESE POLICIES ARE GOVERNED BY THE LAWS OF CONNECTICUT, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES.
12.3 SEVERABILITY: IF ANY PROVISION IS DEEMED INVALID OR UNENFORCEABLE, THE REMAINING PROVISIONS REMAIN IN FULL FORCE.
